12-7-2010 Virginia (4th Circuit):RICHMOND, Va. (AP) — A federal appeals court in Virginia says the law allowing indefinite detention of inmates considered "sexually dangerous" does not violate due process under the Constitution.
The ruling Tuesday by a three-judge panel of the 4th U.S. Circuit Court of Appeals in Richmond reverses a lower court ruling striking down the civil commitment law passed by Congress in 2006.
The appeals court previously upheld the lower court's ruling that Congress overstepped its authority in passing the law, but that ruling was overturned by the U.S. Supreme Court in May. The justices sent the case back to the 4th Circuit to consider the due process claim, which it did not decide the first time around. ..Source.. by LARRY O'DELL
