Man accused in fire at future home of sex offender released, charges not filed

Unbelievable. His burnt face should be enough esp. since he has not explained how that happened. Visits his parent needing medical attention??? Now will he stick around?

2-26-2015 Wisconsin:

MADISON, Wis. - The man accused of burning down a Cottage Grove home before a convicted sex offender could move in appeared in court Thursday.

Russell A. Speigle, 50, was in court for a bond hearing, but no charges have been officially filed.

Prosecutors asked for a $500 cash bond, but Speigle’s attorney claimed his client is not a flight risk, and that he was in Muscoda visiting his parents when he was arrested Monday night.

“He had been in custody two days, not free to leave. He didn’t voluntarily admit himself and yet, four days later, there’s no criminal complaint because they don’t have enough facts upon which to charge him,” Speigle’s attorney, Bruce Rosen, said.

The judge agreed, and released Speigle on a signature bond Thursday afternoon.

The Dane County Sheriff’s Office said fire crews were called to 4721 Gaston Circle in the town of Cottage Grove Sunday night and found flames coming from the home when they arrived.

The house was the target of a suspected arsonist on Dec. 8. In that fire, the home sustained $90,000 in damage. It was recently, but is now considered a total loss after the latest fire.

Speigle was taken to UW Hospital and treated for burns after being arrested Monday. He was released Tuesday, and was subsequently booked into the Dane County Jail on a tentative arson charge.

The house was to be the future home of convicted sex offender Howard Nyberg, 40. Nyberg is currently being held at a supervised living facility in Mauston. He pleaded guilty to second-degree sexual assault of a child in 1994.

Mahoney said Speigle voiced his opposition to the move during a public hearing.

Sheriff's officials said they believe video surveillance footage shows Speigle carrying gas cans toward the house, but deputies have not been able to find the gas cans.

Officials are offering a $5,000 reward to anyone who can provide crucial information pertaining to the investigation by calling the state's arson hotline at 1-800-362-3005. Investigators are also looking into whether Speigle was responsible for the first fire. ..Source.. by Channel3000.com

Arson suspect released from jail, charges possible next week

A town of Cottage Grove man suspected of burning a neighboring home where a sex offender was to live had attracted the eye of police during community meetings about the home, according to search warrants filed Thursday in Dane County Circuit Court.

Russell A. Speigle, 50, was noted by a sheriff's office detective and a state Department of Justice agent as being outspoken at community notification meetings involving plans for 4721 Gaston Circle, where sex offender Harold Nyberg, 40, was to live as part of a supervised sex offender release program, according to the warrants.

The house was destroyed by fire on Sunday night. Speigle was arrested on Tuesday. He appeared in court on Thursday, where he was released on a signature bond and ordered not to possess any gasoline or lighter fluid.

Assistant District Attorney Adrienne Blais said that a criminal complaint will be issued before another appearance scheduled for March 5.

Police on Thursday filed search warrants for Speigle's home and car, his father's home in Muscoda and for DNA and other biological evidence from Speigle's body, such as swabbings from a burned area on his face, along with a medical examination by a doctor for burn injuries to his body.

According to the search warrants:

The Dane County Sheriff's Office had set up infrared trail cameras around the Gaston Circle property, due to concerns about another arson attempt or vandalism.

After the fire Sunday, footage taken by one of the cameras clearly showed a person carrying two five-gallon gas containers kicking open the front door and entering. After about six minutes, an explosion is seen, causing the front windows to blow out. The person who entered the house then left through a broken window.

While firefighters worked at the scene, a sheriff's deputy saw Speigle there. The deputy noticed that Speigle had a "slimy" substance on his face and that his face appeared red. Asked about it, Speigle said it was an allergy related to soap.

Detective Brian Lukens visited Speigle and his wife that night. Speigle denied knowing about the fire's origin, but Lukens noticed that his face was red. Lukens photographed Speigle's face, but Speigle would not let him take a DNA sample.

Shown the photograph, Dane County Chief Medical Examiner Dr. Vincent Tranchida noted that Speigle's eyebrows appeared almost completely singed off, that his eyelashes were singed and that he had soughing of the skin.

Investigators searched Speigle's home on Monday and also had the warrant to take DNA, but Speigle was not home. Speigle's wife, Anne, said he was ice fishing at his father's home in Muscoda.

A Grant County sheriff's deputy found Speigle there and detained him on the DNA search warrant. When Dane County investigators arrived, Speigle started to pack his car to leave. Instead, he was taken to UW Hospital for biological evidence collection and was admitted to the hospital with second-degree burns.

On Tuesday, a sheriff's deputy checking the vicinity of the Gaston Circle house found what appeared to be footprints in the snow between the house and the Speigle home on King Drive. ..Source.. by Ed Treleven

  1. This may be the time to examine origin ; freedom of information act ; or freedom of information law . If its foil there is verifiacation of which the information was released and to whom documented . Hate crime and arson are both register offences by federal law , but will cause a domino effect in our legal system and public safety after time served when it is not recognized .
